The steps that should be carried out by the first attending officer at a scene or incident are listed below.
They do not necessarily need be carried out sequentially, the attending officer has the discretion to act according to the different circumstances he or she may face.
There is a legal standard that is in place that bars the state from convicting the defendant in the following circumstances; if the state and in this case the prosecution together with case investigators fail to preserve “materially exculpatory evidence” or if the state acts in bad faith to destroy evidence that is potentially useful (Acker & Brody, 2013).
In any scenario if the evidence involved is classified as materially exculpatory it is not the defendants duty proving that the state acted in bad faith to the court destroying the evidence however, the defendant only needs to prove to the court, it was the sole duty of the state to preserve that particular evidence despite destruction occurring either due to negligence or in bad faith (Gorelick & Solum, 2009).
Sometimes the prosecution is vulnerable to losing major cases as a result of poor mechanisms for preservation of evidence that will be used to implicate the accused (Acker & Brody, 2013).
However, investigators or police officers at times dent the probability of prosecution convincing the court due to destruction of evidence by these officers that are done in bad faith (Gorelick & Solum, 2009).He has some talent for mathematics and mimicry, and the two abilities enable him to carry on a small game of scaring American tax-payers by letter and telephone: he demands from them ‘further payment’ to an Internal Revenue Service office whose branch, he says, is at a certain address: it is the address of the friend with whom he is staying, and Ripley takes the letters when they arrive, though he can do nothing with the cheques inside them except chuckle with an odd satisfaction. When Ripley finds himself followed one evening in Manhattan streets by a middle-aged man, his first thought is that the man is a police agent, or could be, sent to apprehend him for his fraudulent tax game.A first officer attending a crime scene or incident has to perform a number of critical steps as part of the preliminary investigation. These steps include preserving life, assessing the scene, protecting evidence, managing people at the scene, summoning assistance, securing the scene, guarding the scene and recording a log in their notebook. The man in this case Blair tried to resist arrest as the officer had not fully explained to him the felony he had committed. This paper summarizes five online articles on crime scene photography in order to compile introductory and contextual information on the subject. Photography is one of the four major tasks of crime scene documentation, the other three...The police officer decided to manhandle Blair by kicking him and choking him in order to arrest him successfully. of.....the investigation of a crime scene can either be straightforward or it can come with challenges, which would call for a multidisciplinary approach in order to resolve them. Thus, in the process, there was a by-passer who was watching the whole incident and recorded it on his cell phone but noticing, the police officer grabbed the phone and deleted the video clip. To start with, the investigator can get the wrong impression of the crime scene – for instance, a crime scene that seems to be accidental fire may have been staged to conceal further crimes. When in court the police officer involved told the court that Blair violently resisted arrest and wanted to grab his firearm, claims that Blair vehemently denied. Therefore, hurried conclusions may make the investigator to miss out on important clues. Therefore, it is evident that, the success of criminal proceedings entirely depends on the amount of evidence that is presented before the court proving beyond reasonable doubt that the criminal/accused indeed committed the aforementioned crime to making the prosecution vulnerable to losing major cases because of poor mechanisms for preservation of evidence that would be used to implicate the accused. Of all the available evidences in the area, the most common evidence collected are hair fibers, blood stains, and firearms evidence. Crimes, that are all too prevalent, in modern society, from petty theft to hit and run and from sexual crimes to homicide finding the answers to questions and solving these cases.Ultimately, investigators or police officers at need to exercise due diligence to ensure they preserve evidence implicating the accused person to eliminate chances of the accused being acquitted due to lack of evidence. Even though they are the most common, they are also the most easily contaminated and therefore, must be handled literally with kid gloves. Crime solving is very much like putting together a jigsaw puzzle.
